An exchange visa to conduct work may be issued to a person, who is under twenty-five (25) years of age and has received an offer to conduct work for no longer than one (1) year.The prospective employer must certify that the position exists and make certain prescribed commitments.
Exchange visa (cultural, economic or social exchange programme)
Exchange permits may be issued to foreigners who are not older than 25 years of age and wish to participate in cultural, economic or social exchange programmes administered by an organ of the State or a public higher educational institution in conjunction with an organ of a foreign state.
What is an organ of state?
In terms of section 239 of the South African Constitution, “organ of state” means –
- a) any department of state or administration in the national, provincial or local sphere of government; or
- b) any other functionary or institution
i.) exercising a power or performing a function in terms of the Constitution or a provincial constitution; or
ii.) exercising a public power or performing a public function in terms of any legislation but does not include a court or a judicial officer: This exchange visa may be issued for the duration of the programme.
